Kasus Ribuan Guru Yang Diberhentikan By Sistem

Kementerian Pendidikan dan Kebudayaan (Kemendikbud) telah menelusuri laporan kasus ribuan guru di Simalungun, Sumatera Utara yang diberhentikan. Dari fakta yang ditemukan, ribuan guru itu nyatanya tidak memenuhi syarat kualifikasi strata Sarjana (S1).

“Ketika diberikan waktu 10 tahun sampai 2015 dia enggak melakukan itu dan berarti tidak sesuai dengan Undang-undang. Ini bukan dipecat,” kata Direktur Jenderal Guru dan Tenaga Kependidikan Kemendikbud, Supriano usai Konferensi Pers ‘Gala Siswa Indonesia (GSI)’ di Hotel Grand Sahid Jaya, Jalan Jenderal Sudirman, Jakarta, Selasa, 23 Juli 2019

Pernyataan ini disampaikan Supriano menjawab ramainya pemberitaan diberhentikannya 1.695 guru PNS di Kabupaten Simalungun, Sumatera Utara yang belum memenuhi kualifikasi S1 atau Diploma empat (D4). Dari jumlah tersebut, sebagian guru selama ini mengajar hanya bermodal ijazah Sekolah Pendidikan Guru (SPG), lulusan Diploma II, bahkan masih ada yang lulusan SMA sederajat. 

Setelah diberhentikan, ribuan guru tersebut dialihkan ke posisi lain seperti staf di kecamatan dan sebagainya.  Menurut Supriano, guru yang tidak memenuhi kualifikasi tersebut menjadi temuan Badan Pemeriksa Keuangan (BPK).

Sehingga, guru yang sudah memasuki batas usia pensiun itu tidak dilanjutkan lagi mengajar. “Ini ada temuan juga dari BPK akhirnya mereka mengikuti struktural umur 58. Ketika umur 58 tahun tidak mengambil S1 atau D4 otomatis dia disetop by system dan tidak boleh dibayar lagi. Kalau dibayar itu juga menabrak UU karena syaratnya harus D4 dan S1,” jelas Supriono.

Kasus serupa, kata Supriano, bukan hanya terjadi di Simalungun Sumatera Utara, masih banyak guru di daerah lain yang tak memenuhi syarat juga terpaksa diberhentikan. Padahal waktu jeda untuk menyambung ke jenjang S1 dan D4 yang telah diberikan tersebut lumayan lama.

“Ini juga banyak terjadi di daerah lain. Kalau dia memang dikasih waktu sampai 10 tahun sudah dikasih batas,” tuturnya.

Untuk diketahui, berdasarkan Undang-undang nomor 14 tahun 2005 tentang Guru dan Dosen pasal 8 yang berbunyi "Guru wajib memiliki kualifikasi akademik, kompetensi, sertifikat pendidik, sehat jasmani dan rohani, serta memiliki kemampuan untuk mewujudkan tujuan pendidikan nasional".  Kemudian di pasal 9 menambahkan, "Kualifikasi akademik sebagaimana dimaksud dalam Pasal 8 diperoleh melalui pendidikan tinggi program sarjana (S1) atau

program diploma empat (D4)
